Delamode Group Privacy Policy

This Privacy Policy provides information on how the companies within the Delamode Group process personal data in accordance with the provisions of the General Data Protection Regulation (EU) 2016/679 ("GDPR").

This Privacy Policy also explains your rights as a data subject, the disclosure of your personal data to recipients, and other conditions relating to the processing of personal data that apply to all personal data processed by the Delamode Group for the purposes described in this Privacy Policy. Terms used in this Privacy Policy shall have the meanings assigned to them in the GDPR, unless otherwise specified herein.

Who is the Delamode Group?

The Delamode Group consists of UAB Delamode Baltics, UAB Delamode Transport, UAB Delamode Global Solutions, UAB Delamode Fleet, Delamode Trucking Ltd, Xpediator Plc and other affiliated companies (hereinafter collectively referred to as the "Delamode Group").

Who is the Controller of Your Personal Data?

When processing your personal data, the Delamode Group applies common data protection principles and procedures. The Group companies jointly determine the purposes and means of processing your personal data in accordance with an internal Joint Controller Agreement concluded between the Delamode Group companies. This agreement sets out how the Group companies allocate their respective responsibilities for protecting your personal data, how they cooperate to ensure that your rights are properly exercised, and how they provide you with clear information regarding the processing of your personal data. All Group companies undertake to comply with applicable data protection legislation and to process jointly controlled personal data lawfully, fairly and transparently. Appropriate technical and organisational measures are implemented to ensure the security of your personal data and to protect it against unauthorised access, loss, alteration, destruction or any other unlawful processing.

Please note that, notwithstanding the Joint Controller Agreement, each Delamode Group company may also act as an independent data controller, determining the purposes and means of processing your personal data independently.

The controller of your personal data will be the specific Delamode Group company (or companies) to which you have provided your personal data in connection with existing or prospective contractual or pre-contractual relationships, whose services you use or intend to use, or to which you have provided your personal data for any other purpose. Depending on the purpose of processing your personal data (for example, where several Delamode Group companies participate in the transportation of your shipment), one or more Delamode Group companies may act as the controller of your personal data. When collecting and processing personal data provided by you, as well as personal data obtained from other sources, the Delamode Group adheres to the following principles:

Personal data collected for the purpose of entering into or performing a contract is retained at least until the contract has expired and, following its termination, for up to 10 years in order to protect our legitimate interests and comply with legal obligations, including those relating to accounting, financial reporting and statutory record-keeping requirements. If you have applied to us for a job or traineeship through an advertisement on our website, or on a specialised recruitment and job or traineeship search website, or through our recruitment partner.

Please note that your previous employers may be contacted and asked for their opinion on your qualifications, professional skills and personal qualities, in exercise of their right under the law on the protection of personal data. However, your current employer will not be contacted without your express prior consent.

In cases where you apply for a selection process for a specific job or traineeship advertised by us or our partner, we will process your personal data for the purpose of taking action at the candidate's initiative before the conclusion of the contract (Article 6(1)(b) GDPR).

In cases where you do not apply for a specific position, we will process your personal data on the basis of your consent (Article 6(1)(a) GDPR).

After the selection has been completed, we will retain your personal data on the basis of our legitimate interest in order to contact you in case of a need for a new employee and invite you to participate in a new selection or to make a job offer. (Article 6(1)(f) GDPR).

Providing your personal data to participate in the selection process is voluntary, but if you do not provide your data, we will not be able to assess your suitability and to conclude and execute the employment or traineeship contract.

You can object to the retention of your data after the end of the selection process, in which case we will delete your personal data and will not make future job offers unless you volunteer for a new selection process or resubmit your data. If you object to us keeping your data after the end of the recruitment process, please inform us by sending us your CV and other data, replying to an email or signing an information form during a meeting.

We may also take certain actions in the context of our statutory obligations in relation to our employment or practice relationship.

For the purpose of selection for a job or traineeship, we will process your personal data until we decide to recruit a specific candidate, until the end of his/her probationary period, or until we decide to close the selection without selecting any candidate. If you do not object to such processing of your data, we will keep your CV and other data submitted for the purpose of administering the candidate database for 3 years after the end of the recruitment process, after your consent has been given.

When you make a request of your own free will, we process your personal data on the basis of your consent (Article 6(1)(a) GDPR).

Where we are obliged to deal with your request, we process your personal data on the basis of compliance with legal requirements (Article 6(1)(c) GDPR).

Where your request relates to the performance of a contract, we process your personal data on the basis of the performance of the contract (Article 6(1)(b) GDPR).

In the event of a potential or actual dispute, we process your personal data in our legitimate interest to clarify the circumstances and to deal appropriately with claims and complaints received (Article 6(1)(f) GDPR).

You are not obliged to do so, but failure to provide these data may result in your rights or legitimate interests not being exercised or not being exercised properly.

If the request you make relates to a potential dispute, potential damage, etc., your personal data may be stored for a maximum period of 10 years.

We also receive information about you when you use a social network, interact with the Delamode group on a social network, visit your account on a social network, or follow posts on a social network. The amount of data we receive depends on the account settings we have chosen, the agreements we have made with the social network manager to order additional services, and the cookies set by the social network manager.

Certain processing activities may also be based on the fulfilment of statutory obligations, for example, to comply with legal obligations under accounting legislation (Article 6(1)(c) GDPR).

You must. If you do not provide your personal data, we will not be able to perform our contract with you and provide you with services.

We will retain your personal data for a maximum of 10 years after the goods have been accepted, stored or delivered.

It is in our legitimate interest to ascertain the circumstances and to deal properly with claims and complaints received (Article 6(1)(f) GDPR).

We will keep your personal data for 3 years from the date of the cargo damage/non-compliance document.

May Your Personal Data Be Transferred Outside the EU/EEA?

Personal data collected by the Delamode Group is stored and processed within the European Union (EU) and the European Economic Area (EEA). If your identity cannot be established, we will not be able to verify that the request has been made by the individual whose personal data is being processed and, consequently, we may be unable to fulfil your request.

We may refuse to act upon your request or charge a reasonable fee where the request is manifestly unfounded or excessive, particularly if it is repetitive, or in any other circumstances permitted by applicable law.
